Mark Boswell, the convicted felon and fugitive from Costa Rican justice who uses the alias "Rex Freeman," didn't show up to defend his criminal defamation charge against the editor and publisher of The Panama News, this reporter.

The heart of Boswell alias Freeman's rambling 21 - page calumnia e injuria complaint is the claim that:

Following the idea of his injurious and calumnious intention, the defendant said in his journalistic writing that Mr. Mark Boswell had been arrested by police on charges that "he used fake ID when stopped for a traffic violation and that he used a bogus money order to buy a Mercedes."


And we came to court ready to prove that. See, e.g., the documents and excerpts below.

There will be more work to do defending this case, but on this end the hard work of compiling all the evidence is already done. We're loaded for boar.

Not for lack of Boswell alias Freeman, but for lack of a court reporter, the hearing before Judge Ileana Turner could not proceed and was rescheduled for September 10 at 2:00 p.m.

About a dozen friends, colleagues and supporters showed up at the courthouse and again the call is being put of for people to gather on the Supreme Court steps before the hearing, and for those who have the time and stomach for such stuff to come on up to the courtroom on the third floor and attend the hearing.

Yes, the issue is freedom of the press, and the public's right to information about the criminal element that moves amongst us. But understand that this is a continuing crime wave: "Rex Freeman" is in Panama offering an "aggressive" investment fund that he claims yielded 26 percent return on investment per month last year, and offering banking services, neither of these activities being registered with the Comision Nacional de Valores nor the Superintendencia de Bancos as required by Panamanian law. The Torrijos administration, despite all of its posturing against crime and against terrorism, let this self-proclaimed "Ex-Pat Warrior" into Panama despite his criminal past, and allows him to flout Panamanian law.

Thus what was a legal defense is now morphing into a political offensive. This reporter is going to do his utmost to make Mark Boswell alias Rex Freeman the PRD's running mate in the upcoming elections, the living symbol of that party's corrupt practices and totalitarian attitudes.

And the court case? Mark Boswell's complaint was not accompanied by a sworn statement by him personally, claiming that the allegations of fact within it are the truth. He seems to be afraid to show his face in court. Below you can see some of the proofs we intend to present, and those will be refuted by what? We think that it's quite likely that the charges will be provisionally dismissed, with Boswell alias Freeman given an opportunity to file some proofs if he has them. However, if the case is not dismissed, it can reasonably be expected that it will outlast the Torrijos administration. Usually when an administration changes, the price of protection for a notorious scam artist who wants to operate out of Panama goes way up.

He moved among the far right up there

Common law courts operate outside the legal judicial system, and those who participate as judges and juries can be charged with impersonating public officials and panels. Such legalities didn't dissuade [Republican] state Senators Tebedo and Duke from appearing before this Canon City grand jury.

When common law activists adjourned for lunch, police arrested Mark Boswell on a fugitive warrant. Boswell had allegedly used a false identity during a traffic violation incident and had purchased a Mercedes with a bogus money order.

Duke indignantly deemed Boswell a "political prisoner" and several months later sponsored a Senate bill that would require federal agents to notify county sheriffs before executing warrants. Among those who testified at his committee hearing this past spring were Van Pelt and Reeser.

Boswell is also a broadcaster on the Johnstown-based USA Patriot radio network (renamed the American Freedom Network after the Oklahoma City bombing). The latest personality added to the American Freedom Network's Saturday morning line-up is Senator Duke, who also spoke at the August 31 national militia rally in Washington, D.C.

Summary of Mark Boswell's radio talk show of 12 AM EDT on April 29, 1995

Boswell interviewed 25 year CIA veteran James Black and assistant Ron Jackson regarding sworn affidavits now in their possession, sworn by two Justice Department officials which state that they were part of a "Committee of 10" who planned the Oklahoma bombing.

The Officials claim the bomb was supposed to be detonated at 6 AM (with no one around) as a scare tactic to procure sympathy, money and power for government agencies, but that something went wrong and it was detonated later during business hours. This could explain why McVeigh was reported being so lost while driving the bomb-truck to the scene that he had to stop and ask a policeman for directions.

The officials have retained a prominent East Coast attorney and they and their families are now in hiding. Their Affidavits have reportedly been delivered to a prominent government official who will be asked to launch a proper course of action. It was promised that if he does not soon, then the Affidavits will be faxed via the interviewee's fax network to an approximate 200 million recipients. Associated Press has been informed and is investigating (check for yourself by calling 405-525-2121).

ATF LINK TO BOMBING

On the previously mentioned talk show, it was also revealed that the day prior to the explosion, BATF Agents underwent explosives training in the basement of the Federal Building. After that training, a number of agents were told not to come to work at the office the next day, but to report elsewhere. When one asked "why", a confidant instructed that the building was "coming down." He and several of fellow ATF agents have retained the same attorney that the Justice officials have.

SECRET SERVICE AGENT OVERHEARS BOMB TALK PRIOR TO

On the previously mentioned radio talk show, it was also revealed that a Secret Service agent overheard shrouded talk in the White House regarding the bombing on the day before it occurred, but did not understand the significance of what he had heard until the details of the blast and the President's propaganda speeches which followed started matching what he had previously heard. The Secret Service agent has reportedly retained the same attorney as the Justice officials and ATF agents have.

Doom and Doomer

Even some patriots wonder about the movement's real agenda: Is it profit or politics? Before and after every point is made about defending the Constitution, someone has something to sell. For example, Mark Boswell, who hosts a weekly show on KHNC and runs a regular meeting for patriots in Denver, offers pricey seminars on common law and the Constitution and allows fellow patriots the chance to pitch money-making schemes hatched in faraway places.

"It's the American way," Boswell says. But profits don't change the fact, he adds, that Hillary Clinton was secretly indicted on April 17 for financial wrongdoing and that two Justice Department attorneys confessed to having planned and financed the Oklahoma City bombing and then were spirited out of the country.

"It's documented," Boswell says. "The facts will come out."

The sign for the meeting in the pleasantly moldy Veterans of Foreign Wars hall in downtown Denver reads "Welcome, Patriots and Militia!" But it refers to campaigners in a domestic war.

Tables are lined with a bewildering assortment of brochures and tapes, a brew of fundamentalist Christianity, libertarian-style tracts, merchandise order forms and cranky newspapers filled with anti-government propaganda.

Among the fliers is a "Prayer of Agreement to Bind the Enemies of America," which starts: "In the holy, blessed Name of the Lord, Jesus Christ of Nazareth, by the Power of His Blood and with the full authority vested in us, from our Seat in the heavenlies, at the right Hand of God, All Mighty: We now bind and gag the councils of the governing demons of Hades, who meet to devise plans against us or any members of our families...We also put you to shame, turn you back and bring all your meetings to a state of confusion! This we speak in the full Power and Authority of Jesus Christ, to all who desire our hurt..."

If that's too heavy, you can order a spiffy nylon jacket for $30 that says Civil Rights Task Force (CRTF on the back), a shiny gold badge for $80 or business cards for only $76. Boswell's American Law Club offers a "sovereignty training course" for $145 and a "V.I.P. Educational Fellowship Self-Study Program With Guidance" for $550. Freebies on another table include two "fact sheets" from Pat Robertson's 700 Club that unravel the mysteries of the U.N. and AIDS.

The sixty people who filter past the tables gather in small groups to informally discuss, with quiet certainty, the fact that the federal government blew up its own building in Oklahoma City.

... Mark Boswell, who runs the meeting, urges people to buy those nice "CRTF" jackets (which purposely look identical to jackets worn by ATF and FBI agents) and wear them into courtrooms. Once there, these patriots are to tell the judge that he is being watched and graded by them on his performance. Boswell is marketing the jackets and assorted badges and other gewgaws from the deceptively named U.S. Civil Rights Task Force, based in Fremont, California.

The main speaker of the evening is a patriot named Dale Pond from Fort Collins, where he runs a barter network that uses its own paper "money" emblazoned "In Each Other We Trust." He passes the "bills" around the audience. The aim is to set up an alternate economy, something separate from the corrupt system in which most people are trapped. Literature on one of the tables in back advocates that such a system could be based on the "Hebrew-Judaic Commercial Code," which supposedly states that "a workman is worthy of his hire." The idea is that labor is the key toward valuing a product or service.

But there's not much labor involved in another idea Pond is hawking. It's a plan from the North American Freedom Council in Boonville, Indiana, to make millions of dollars for ordinary patriots by filing unconventional "non-commercial judicial liens" and acquiring "security drafts" through the banking system. Some patriots have landed in jail for filing false liens against judges, prosecutors, politicians and corporations, but Pond insists this is a completely different plan and has a chance of working.

It's easy to participate, he tells the group: Simply send a credit-card bill and several hundred dollars in cash to the Freedom Council, which will take care of all the paperwork, filing a multimillion-dollar lien against the bank that issued the credit card and somehow collecting on it.

"This is a God-given opportunity here," Pond says. "We've got a huge patriot movement, and everybody's dead broke. Here's funding for the patriot movement. We're going to have billions coming in this summer. This is going to be a short-lived thing; we're going to get in and get out."

After Pond's pitch, several audience members ask where they should send their money.

As Boswell calls the meeting to adjournment--a bull session will continue for several hours afterward--he reminds the audience of his own Saturday-morning talk show on KHNC, the "Citizen's Rights Forum." Still modeling that snazzy CRTF jacket, he concludes with a note of empathy for those who are fighting the government. "Sometimes," he says, "it really feels like we're up against a monster."

Irresponsible Investigative Journalism Rampant in Panama

By DON WINNER for Panama-Guide.com - People are running out of patience with irresponsible reporting in the English language on the Internet in Panama. Roger Gallo from Escape Artist.com recently notified Eric Jackson of www.thepanamanews.com that Jackson has 72 hours to remove articles and materials Jackson published about Gallo which Gallo considers to be slanderous. If Jackson does not comply Gallo threatens to take legal action against Jackson. I say, it's about time. Eric Jackson has been slandering people with impunity for years, simply because no one has taken the time to hold him to task. Going after someone like Jackson is usually more hassle than it's worth, and if you have to pull the skunk out of the garbage can you usually just end up smelling like both skunk and garbage.

Concentrated Return Fire: One of the quirks about the Panamanian justice system with regards to these kinds of criminal slander complaints is that if a guy like Eric Jackson has five or six or seven criminal complaints against him, then he will most likely be seen by the same criminal prosecutor and judges who have been specially trained to deal with these kinds of criminal complaints. There are two (and only two) prosecutors in the Public Ministry who are qualified to investigate and prosecute criminal complaints for slander and defamation. Irresponsible writers and reporters can effectively spread their wrath out against a wide audience of victims, but the complaints of their victims against the writers effectively become condensed to a fine point, thanks to the way the legal prosecution system is established. The trick seems to be banding together as victims to compel serial slanderers to be more responsible and contemplative in their reporting through legal action.

Nice To Meet You, Rex: Rex Freeman is the guy who already has a criminal complaint filed Eric Jackson for slander. The day after I posted a photo of myself and Rex Freeman on Panama-Guide, Okke Ornstein yanked down his website (also known as the Noriegaville online criminal evidence repository.) You can bet that all of the people who have been slandered by these guys over the years are now banding together to fight back and insist on responsible reporting. And, just a week after I got together with Rex Freeman, Roger Gallo sent the following email to Eric Jackson:

Jump On The Bandwagon: Been slandered lately? Did you print a copy of the story? It takes about an hour to wander down to the PTJ and file a complaint. If it's bullshit, you really don't have to take it anymore. In fact, I recommend that you don't take it at all. The tide has turned in favor of responsible journalism, and it's about damn time.

But what are the 13th, 14th and 15th amendments?

"Article XIII (1865): Neither slavery nor involuntary servitude, except as a punishment for a crime whereof the party shall have been duly convicted, shall exist within the United States...."

"Article XIV (1868): All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.... No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of live, liberty or property, without due process of law; nor deny any person within its jurisdiction the equal protection of the laws...."

"Article XV (1870): The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color or previous condition of servitude...."

And when you scratch the surface, isn't a reversal of the constitutional verdict on the Civil War what the far right in the USA --- including its pathetic followers here --- has always been about?
