Editorials: Martinelli’s special impunity; and The integrity of women’s sports

Nothing special — just the smell
of a purchased judgment

Two of the three magistrates of the Electoral Tribunal have taken upon themselves jurisdiction to decide matters of criminal and extradition law that are well beyond the tribunal’s jurisdiction.

Magistrates Araúz and Juncá say that as party boss of his own party, Ricardo Martinelli has candidate’s immunity from criminal prosecution for an election for the party’s youth and women’s organizations — but as owner of the RM party Martinelli himself faces no vote on his own leadership. That’s twisted, but arguably within the realm of the Electoral Tribunal’s jurisdiction.

The two magistrates went out of their bailiwick to declare that the principle of specialty in extradition law prevents Ricardo Martinelli from being tried in a pending case for taking bribes from the Brazilian construction company Odebrecht and together with his sons laundering those millions. (Note that in their guilty pleas before a US federal district court in Brooklyn, Martinelli’s two sons implicated him as the source of the bribe money they laundered.) They say that the specialty principle prevents Ricardo Martinelli from being tried in a pending case for the theft of public funds through kickbacks on overpriced public construction contracts and using the money to buy himself the cornerstone of his media empire, the EPASA newspaper chain (El Panama America, La Critica and Dia a Dia).

By their reasoning, Martinelli would also not be able to be brought to justice for the televised torture execution of boys at the Tocumen juvenile detention facility and subsequent delivery of the boys’ rotting bodies to their families by way of the National Police leaving them in plastic garbage bags at their doors. Or any other offenses during Ricardo Martinelli’s 2009-2014 crime wave administration.

In any case, beyond the injustice and overstepping of the bounds of their jurisdiction in which magistrates Juncá and Araúz indulged, they are wrong about the substance of the specialty issue. Not only do they lack the power to overrule criminal courts’ decisions as they have purported to do, their take on the law is clearly erroneous.

Yes, the 1904 US-Panama extradition agreement has a specialty clause. Under that treaty, if a person is extradited for one crime, he or she may not be tried for another crime that was committed before the extradition without being allowed the opportunity to promptly return to the country from whence extradited.

However, Panama’s extradition request to the United States was not only made pursuant to the 1904 treaty. One of the other grounds asserted was the Bucharest Cyber Crimes Convention. Not only does that treaty lack a specialty clause, but it has a provision that excludes that:

Do we want to get into international customs? Cases in different jurisdictions are all over the map, but generally if an extraditing country wants to put limits on the prosecution of a suspect it spells out the condition or conditions and the receiving country tends to respect those conditions. So Canada won’t extradite somebody to the United State to face a death penalty, and US justice respects that, even in the most horrific cases. So when France sent Manuel Antonio Noriega back to Panama it insisted on something like a specialty clause — and that was being litigated here when the old general who deserted his post under fire died.

The United States says that the specialty principle does not apply to Ricardo Martinelli. We should not accept US edicts as the determinants of Panamanian law, but the customary way of looking at it is that Martinelli was extradited from the USA without benefit of a specialty clause.

Panama’s criminal courts and Supreme Court have decided the issue. The principle of specialty in extradition does not protect Martinelli in the Odebrecht and New Business cases. For the Electoral Tribunal to purport to rule otherwise is outrageous and if we are to get into the rule of law, the offense of overstepping the limits of legal authority.

Not that our thuggish legislators are about to do anything about that offense, but the high court might and should strike down Juncá’s and Araúz’s power grab.

Who is or isn’t a woman is not the only challenge for women’s sports. Consider the gifted and charming figure skater Katarina Witt, who performed for the former East Germany’s team. After the Berlin Wall fell and the Stasi secret police archives were made public, there were allegations of the most serious sorts of ethical violations — spying on her fellow athletes. But on closer inspection it turned out that she was the constant victim of Stasi surveillance, not a Stasi agent as claimed. Women’s figure skating now faces another ethical problem, an alleged drug violation by a 15-year-old Russian skater and the way that she was flagrantly manipulated by adult handlers. So should there be a minimum age requirement, such that a kid doesn’t just automatically take whatever medication she’s given by an adult authority figure and end up banned from sports? The integrity of women’s sports

For the purposes of elite sports, should a trans woman be considered a woman? What about a woman born with all the female plumbing, but inside here body vestigial testicles that pump out the male hormone testosterone? What about the baby who, at diaper change times, showed two little testicles and a vagina in between?

Notwithstanding what might be inferred from ancient religious scriptures, in nature there are people — and animals — that are born neither male nor female, or both. And since ancient times, there have been cruel fanatics who have killed or otherwise brutalized such people and used religious arguments to justify it.

And across the USA, Republicans are mobilizing such fanatics for this year’s midterm elections. They are, however, less than unanimous. Caitlin Jenner, a trans woman who as a man was the world decathlon champion and as a woman ran for governor of California, says she doesn’t really know about the propriety of trans women competing in elite women’s sports — and she’s a Republican. In the state of Utah, a Republican governor and Republican legislative majorities have gotten into a big fight over a law to ban transgender kids from school sports. As far as is known, this law passed over the GOP governor’s veto currently affects four people, three trans boys and one trans girl, none of them star athletes. But a trans woman just won an NCAA championship medal, and there are women athletes complaining about this, demanding that their sports be restricted to “biological women.”

So who’s a woman? Is it determined by reference to a birth certificate filled out by a nurse or obstetrician after cursory examination? Is it determined by what a person wants to be called? Is it based on body morphology? Or based on body chemistry?

These are arcane questions, but when into the realm of elite sports there’s a lot of money involved. So do university athletic directors, television and advertising executives or the International Olympic Committee decide? Or politicians out to prove to the voters how devout they are?

References to chromosomes and to body chemistry seem much more fair that competing holy scriptures.

But to maintain the integrity of women’s sports, shouldn’t it be female athletes who set the standard?

Otherwise the politicians, the owners of the sports businesses or the hierarchs of religious institutions would be turning top athletes into their slaves.

WHO establishes the Global Center for Traditional Medicine in India

Maximizing the potential of traditional medicines
through modern science and technology

On March 25 the World Health Organization (WHO) and the Government of India signed an agreement to establish the WHO Global Center for Traditional Medicine. This global knowledge center for traditional medicine, supported by an investment of $250 million US from the Government of India, aims to harness the potential of traditional medicine from across the world through modern science and technology to improve the health of people and the planet.

Around 80 percent of the world’s population is estimated to use traditional medicine. To date, 170 of the 194 WHO Member States have reported the use of traditional medicine, and their governments have asked for WHO’s support in creating a body of reliable evidence and data on traditional medicine practices and products.

“For many millions of people around the world, traditional medicine is the first port of call to treat many diseases,” said Dr Tedros Adhanom Ghebreyesus, WHO Director-General. “Ensuring all people have access to safe and effective treatment is an essential part of WHO’s mission, and this new center will help to harness the power of science to strengthen the evidence base for traditional medicine. I’m grateful to the Government of India for its support, and we look forward to making it a success.”

The term traditional medicine describes the total sum of the knowledge, skills and practices indigenous and different cultures have used over time to maintain health and prevent, diagnose and treat physical and mental illness. Its reach encompasses ancient practices such as acupuncture, ayurvedic medicine and herbal mixtures as well as modern medicines.

But today, national health systems and strategies do not yet fully integrate the millions of traditional medicine workers, accredited courses, health facilities, and health expenditures.

“It is heartening to learn about the signing of the Host Country Agreement for the establishment of Global Center for Traditional Medicine (GCTM). The agreement between Ministry of Ayush and World Health Organization (WHO) to establish the WHO-GCTM at Jamnagar, Gujarat, is a commendable initiative,” said HE (Mr) Narendra Modi, Prime Minister of India.

“Through various initiatives, our government has been tireless in its endeavour to make preventive and curative healthcare, affordable and accessible to all. May the global Center at Jamnagar help in providing the best healthcare solutions to the world.”

Traditional medicine is also increasingly prominent in the world of modern science.

Some 40 percent of approved pharmaceutical products in use today derive from natural substances, highlighting the vital importance of conserving biodiversity and sustainability. For example, the discovery of aspirin drew on traditional medicine formulations using the bark of the willow tree, the contraceptive pill was developed from the roots of wild yam plants and child cancer treatments have been based on the rosy periwinkle. Nobel Prize winning research on artemisinin for malaria control started with a review of ancient Chinese medicine texts.

There has been a rapid modernization of the ways traditional medicine is being studied. Artificial intelligence is now used to map evidence and trends in traditional medicine and to screen natural products for pharmacokinetic properties. Functional magnetic resonance imaging is used to study brain activity and the relaxation response that is part of some traditional medicine therapies such as meditation and yoga, which are increasingly drawn on for mental health and well being in stressful times.

In addition, traditional medicine use has also been updated by mobile phone apps, online classes, and other technologies.

The new WHO center will be established in Jamnagar, Gujarat, India. While Jamnagar will serve as the hub, the new center is being designed to engage and benefit all regions of the world.

It will concentrate on building a solid evidence base for policies and standards on traditional medicine practices and products and help countries integrate it as appropriate into their health systems and regulate its quality and safety for optimal and sustainable impact.

The new center focuses on four main strategic areas: evidence and learning; data and analytics; sustainability and equity; and innovation and technology to optimize the contribution of traditional medicine to global health and sustainable development.

The onsite launch of the new WHO Global Center for Traditional Medicine in Jamnagar, Gujarat, India will take place on April 21, 2022.

Righting the Wrong: Should NATO enter the Russian-Ukrainian fray?

It is hard to describe the excruciatingly painful destruction Putin is inflicting on Ukraine. However, whereas NATO should provide Ukraine with active defensive military equipment, it should not directly join the war, which could ignite a major European if not world war.

There are growing voices from academia, the military, and former and current American and EU officials calling on the Biden administration to heed Ukrainian President Zelensky’s appeal to impose a no-fly zone over Ukraine. Beyond a no-fly zone, they raise a legitimate question — do the United States and its allies have a limit as to how far and for how long Russia’s President Putin can indiscriminately bombard Ukrainian cities, killing thousands of innocent men, women, and children, before NATO intervenes to end the slaughter? Indeed, everyone with a conscience feels the horror of this unprovoked and utterly unjustified war. However, if we want to prevent an all-out war in Europe, we have to be extraordinarily prudent and not allow our sense of outrage about the war succumb to our compassion and moral obligation, albeit it should be the right thing to do.

There are many reasons why we should not confront Russia directly, especially now that we are taking many non-military measures, including crippling sanctions, while remaining united and resolved to indirectly inflict heavy military losses on Russia and render it a pariah state. In addition, once they become aware of the unspeakable horror Putin is inflicting on the people and cities of a peaceful neighbor, the Russian people would rise against their corrupt and brutal leader who is misleading them and subjecting them to nothing but more pain and misery.

Here are several reasons why NATO should not get directly involved in this horrific war and what it must do to inflict indirectly the heaviest toll on the Russian army while exposing Putin as a war criminal.

First, introducing a no-fly zone would pit NATO directly against Russia, as it will require an extensive campaign against Russian jet fighter planes, as well as destroying Russia’s S-300 and S-400 air defense systems, which Russia would certainly use to intercept NATO missiles enforcing a no-fly zone. This move would escalate and draw NATO into a broader war.

Second, at the present the Russian people are demonstrating in growing numbers against the war as the public is becoming increasingly informed, with nearly 5,000 arrested at protests. However, if NATO intervenes and expands beyond Ukraine’s borders, and NATO begins to attack numerous targets inside Russia, it would doubtless galvanize Russians against Western powers, when in fact the precise opposite is what the NATO alliance wants to realize.

Third, several European countries who are not NATO members, especially Sweden and Finland, do not want NATO to go to war with Russia, fearing that they would eventually be dragged into it without having NATO’s protection, such as the case with Ukraine. They prefer to see Putin suffer from the consequences of his ill-fated misadventure.

Fourth, while most military analysts agree that Russia will lose any conventional war against NATO, given Russia’s history and imperial mindset, losing a conventional war against NATO will be a recipe for the next war between them. This would destabilize Europe for decades, which should be avoided unless Russia attacks any NATO member state first.

Fifth, by avoiding direct military involvement, NATO will spare the lives of tens if not hundreds of thousands of soldiers and civilians on both sides. And so long as the West continues to supply Ukraine with military equipment while Russia is sustaining crippling sanctions and heavy military losses, NATO should continue with this strategy which may precipitate a coup inside Russia itself.

Sixth, a direct confrontation with Russia could deliberately or accidentally escalate and engulf many countries beyond the European theater. This will essentially put us at the precipice of World War III. This must be avoided by any means possible unless Russia attacks first and leaves the West with no choice other than waging an all-out war against Russia.

Seventh, prior to escalating the conflict with Russia, NATO must consider where China stands. As Putin’s atrocities are exposed, the Chinese may well heed the US call to play a constructive role by using its influence on Putin to end the war without further catastrophic losses. Given however the closeness between Putin and President Xi, the latter would not do so if NATO engages Russia militarily.

Eighth, given that Russia’s conventional weapons are still limited and considerably inferior to the combined forces of NATO, and given Russia’s considerable losses, Putin may resort out of desperation to using tactical nuclear weapons which is the mother of all catastrophes. This is the worst of all possible scenarios. The United States and its allies must spare no effort to prevent it.

Finally, regardless of how distasteful it would seem to make any concession to Putin to end the conflict, we need to weigh the consequences of a prolonged war on the Ukrainian people. To avoid that, it will be necessary to offer Putin a face-saving way out, bearing in mind that there are no other realistic alternatives.

This may include Ukraine becoming a neutral country and committing not to join NATO, to which President Zelensky has already conceded. And instead of recognizing the independence of Donetsk and Luhansk, as Putin is demanding, Zelensky could offer to declare these two provinces semi-autonomous and also agree to acknowledge Russia’s sovereignty over Crimea, which in any case Russia is unlikely to ever relinquish. An agreement along these lines would make Ukraine a buffer zone between East and West as long as its independence, national security, and territorial integrity are guaranteed by both Russia and the United States.

This general framework for a solution is neither fair nor morally correct, but it must be weighed against the potential continuing massive destruction and loss of lives in the tens, if not hundreds, of thousands. Moreover, the prolongation of the war could escalate and pit NATO against Russia with the potential of introducing weapons of mass destruction, which will be catastrophic and of unprecedented scale and must be avoided at any cost.

Any war, regardless of causes and circumstances, is tragic. Though the Ukrainians have and continue to suffer unimaginably, the big loser is Russia and Putin in particular. The Russian people, who are acutely suffering from the sanctions, will sooner than later find out the scale of destruction and death that Putin has inflicted on a peaceful neighbor, which many Russians believe to be historically, culturally, and linguistically part of Russia. It is incomprehensible to many how their leader, who has been invoking this affinity to Ukraine, would wage such merciless war against innocent men, women, and children, and decimate their cities to a degree unseen since World War II. Putin knows that; he is boxed in and desperately needs a way out.

Putin will be watching carefully what comes out of the summit between NATO heads of states. The message Putin should receive must be unequivocal, clear, and absolutely credible. He should be warned that NATO’s response to the use of any kind of weapons of mass destruction will be quick, decisive, and painful, which would render Russia a bankrupt, pariah, and failed state, and he will personally be charged with war crimes.

Putin will be remembered as the Russian despot who not only failed to restore his pipe dream of the Russian Empire but savagely destroyed Russia’s international standing, from which it will take decades to recover.

The West must learn a cogent lesson from this gruesome war and remain united, vigilant, militarily prepared, and become energy independent from Russia. They should know that the Russian bear will still be lurking in the dark for years if not decades to come, but will dare not threaten the West knowing that only a humiliating and costly defeat will await him.

World’s second-biggest reinsurer moving out of fossil fuel projects

So, what does it have to do with Panama, which has few exploited hydrocarbon resources? First of all, Panama is an outsized power in the reinsurance business and our companies may end up following a business trend that the Swiss are starting. Then, even though we boast of being a carbon-neutral or even carbon-negative country, we are affected by the climate changes that are largely driven by fossil fuel consumption. And those negatively affected by such trends may not be able to get affordable insurance. ‘Big News’ for climate as global insurance giant shifts away from fossil fuels

After Swiss Re, the world’s second-largest reinsurer, announced Thursday that it is moving to end coverage for most new oil and gas projects, climate justice campaigners who have long pushed for the insurance industry to shift away from fossil fuels offered cautious praise.

“Swiss Re is one of the world’s ultimate risk managers and the policy which it published today sends a strong message to fossil fuel companies, investors, and governments: oil and gas operations need to be phased out in accordance with climate science or they may become uninsurable by the end of the decade,” Peter Bosshard, global coordinator of Insure Our Future, said in a statement.

In its annual sustainability report on Thursday, Swiss Re said it would no longer insure projects that get the go-ahead from their parent company from 2022, unless the company has an independently verified, science-based plan to reach net-zero emissions.

By 2025, Swiss Re said it wanted half of its overall oil and gas premiums to come from companies aligned with such a net-zero by 2050 plan, and by 2030 all its clients in the sector should have done so.

Also, from 2022, the company said it will no longer insure companies or projects with more than 10% of their production in the Arctic, apart from Norwegian producers.

On the issue of treaty reinsurance, whereby it insures bundles of risk in a job lot, Swiss Re said it expected to finalize a policy for the oil and gas sector in 2023.

“By taking steps to stop insuring new oil and gas projects and companies that won’t aim at aligning their activities with climate science by 2030, Swiss Re is headed in the right direction,” said Reclaim Finance director Lucie Pinson.

“The policy is not perfect yet,” she added, “and we encourage its peers to build on it to fully align with a realistic 1.5°C scenario.”

The International Energy Agency (IEA) said last May that there is “no need for investment in new fossil fuel supply” if the world is to achieve a net-zero energy system by 2050 en route to meeting the Paris agreement’s more ambitious global warming target.

Swiss Re, said Pinson, should respond to the IEA’s landmark report by “drawing a red line against fossil fuel expansion and excluding both projects and companies that cross that line well before 2025.”

Sharing a detailed Twitter thread by Bosshard, Oil Change International celebrated Swiss Re’s move. Becoming the first major oil and gas insurer to deny coverage for most new fossil fuel projects is “big news,” said the group.

Arguing that “ending support for oil and gas projects is gaining real momentum,” 350.org also praised Insure Our Future and encouraged its campaigners to “keep up the good work.”

According to Bosshard, Swiss Re’s phase-out commitment represents “a first for the insurance industry” because it “not only applies to the up and midstream sectors, but also to downstream companies (oil refineries, gas utilities, petrochemical plants etc.) without credible net-zero plans.”

However, he continued, “the new policy includes some important gaps and contingencies.”

“It will not cover new production projects which oil companies move forward as part of their ongoing operations,” said Bosshard. “It also exempts Norway from its definition of Arctic oil. The IEA doesn’t make any such exemptions.”

“Most importantly, the policy hinges on the development of a credible oil and gas framework by the Science Based Targets initiative [SBTi], by which oil companies’ net-zero plans will be measured,” he added. “It’s crucial that the SBTi framework reflect the findings” of the IEA and the United Nations.

Swiss Re’s new policy follows similar policies adopted last week by Hannover Re and Mapfre, said Bosshard, who pointed out that “these three companies cover 21% of the global reinsurance market.”

“Now, the Insure Our Future campaign calls on Munich Re, Lloyd’s, and SCOR, which together account for 26% of the global reinsurance market, to make commitments which build on Swiss Re’s approach by the time of their annual general meetings,” said Bosshard.

Se aprueba nuevo Plan de Manejo para el área protegida de la Cordillera de Coiba

En junio de 2021, Panamá amplió el área marina protegida de la Cordillera de Coiba de 17 mil a 68 mil kilómetros cuadrados aproximadamente, cumpliendo anticipadamente con la meta de la “Iniciativa 30×30” del Marco Mundial de la Diversidad Biológica de proteger el 30% de las áreas marinas del país para el 2030. Menos de un año después, en febrero de 2022, el biólogo marino del Instituto Smithsonian de Investigaciones Tropicales (STRI) Héctor Guzmán, junto a un equipo consultor multidisciplinario, entregó el plan de manejo final para el área protegida ampliada que fue recientemente aprobada por el Ministerio de Ambiente de Panamá, según resolución número DM-No. 0089-2022 del 3 de marzo del 2022.

El área protegida ampliada de la Cordillera de Coiba, ubicada a 100 km al sur del Parque Nacional Coiba, es única en que cuenta con varias cadenas montañosas submarinas llenas de mucha biodiversidad por descubrir. Es un ecosistema que resguarda catorce especies de mamíferos marinos que la usan como zona de migración y alimentación, como la ballena azul, el cachalote y el rorcual del norte, además de tortugas marinas, peces picudos, tiburones y otras especies, en su mayoría vulnerables o en peligro de extinción según la Unión Internacional para la Conservación de la Naturaleza.

La ampliación del área marina protegida de la Cordillera de Coiba mejora la conectividad del Corredor Marino del Paciìfico Este Tropical, fortaleciendo la conservación y el uso sostenible de las aguas protegidas entre Isla de Coco en Costa Rica, Galápagos en Ecuador, Malpelo y Gorgona en Colombia y Coiba en Panamá.

“Meses de arduo trabajo con nuestro equipo consultor y más de 20 consultas ciudadanas nos permitieron diseñar y justificar la extensión y el Plan de Manejo del área protegida Cordillera de Coiba”, dijo Guzmán. “Gracias a los fondos de la Fundación Wyss y STRI y al apoyo de la Fundación MissionBlue, la Red Migramar y las autoridades locales por hacer posible esta labor”.

El biólogo marino y conservacionista del Instituto Smithsonian, Héctor M. Guzmán, trabajó en el desarrollo y redacción del plan para el manejo del área protegida ampliada.
